Terms of Service
Effective as of October 23, 2026
These Terms of Service (“Terms”) are a binding agreement between you and InOutBoard.com, Inc. (“InOutBoard,” “we,” or “us”). Please read them carefully.
These Terms apply to your use of every website that links to them, and of the services we offer through those websites. In these Terms, “Sites” means all of those websites and services. By using the Sites, or by signing in to them, you agree to these Terms and to our Privacy Statement.
If you have signed a separate agreement with us for our products or services, on paper or electronically, its terms also apply to your use of those products and services and form part of your agreement with us.
A. Your Accounts
Some features of the Sites need an account and a password. To create an account, you must be at least 18 years old, and the information you give us about yourself must be true and accurate. Do not pose as anyone else when you create an account, and keep your account details up to date if they change. InOutBoard is a workplace service for adults: accounts, and the staff records an administrator creates, are for people aged 18 or over.
Your account may instead be set up for you by an administrator, such as your employer or the organization you work for. If so, other terms may also govern how you use the Sites, and your administrator may be able to access your account, or disable it, without involving us.
Your account is for you alone, so do not share it. Keep your password confidential and avoid using it anywhere else. If you think your account has been compromised, tell your system administrator.
B. Changes to the Sites
We may change the Sites at any time, with or without telling you first. For example, we may add or remove features and functions, or suspend or discontinue a feature entirely. We may also charge a fee for any feature at any time. If you are unhappy with a change, you are free to stop using the Sites.
C. Content You Post
The Sites may let you post text, photographs, videos, and other material (together, “Content”). Post Content only if you own all the rights to it, or if whoever does own them has given you permission.
Posting Content does not transfer your ownership of it. By posting it, however, you give us, our agents, licensees, and assigns a non-exclusive, perpetual, and irrevocable right and permission to reproduce, encode, store, copy, transmit, publish, post, broadcast, display, publicly perform, adapt, modify, create derivative works of, exhibit, and otherwise use your Content. We need these rights to operate the Sites. This license continues after you stop using the Sites.
You agree to indemnify, release, and hold us harmless from any and all liability, claims, actions, loss, harm, damage, injury, cost, or expense arising out of any Content you post.
Anything you send us, including information, ideas, and suggestions, is not confidential. Unless we tell you otherwise, we may reproduce, use, disclose, and distribute it without any obligation to you.
D. Content Posted by Others
We do not endorse, and are not responsible for, Content that anyone else posts. Nor are we liable, directly or indirectly, for loss or damage you suffer because of Content posted by another user.
E. Your Use of the Sites
Do not use the Sites in any way that breaks the law, infringes anyone’s rights, is offensive, or disrupts the Sites or any of their features, including the technical measures we use to enforce these Terms.
We trust you to use good judgment rather than give you a list of everything not to do. If we decide, at our sole discretion, that you have acted inappropriately, we may remove Content, close your account, bar you from the Sites, and take appropriate legal action.
Using the Sites gives you no ownership of the intellectual property in the content you access. You may use content from the Sites only with permission from us or its owner, or where the law otherwise allows.
When you use the Sites, or send us communications through them, you are communicating with us electronically, and you consent to receive communications about your use of the Sites electronically. We may contact you by email, or through notices posted on the Sites. You agree that agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that they be in writing. A notice we send you is treated as delivered and effective when it is sent to the email address you gave us. If you post Content, create an account, or otherwise give us an email address, postal address, or phone number, you agree that we or our agents may use it to contact you, as described in our Privacy Statement.
F. Intellectual Property
If you believe Content on the Sites infringes your copyright, email us at support@inoutboard.com to ask us to remove it or disable access to it.
G. Our Warranties and Disclaimers
We operate the Sites with a commercially reasonable level of care, and we promise to do our best to make using them a good experience. There are, however, some things we do not promise.
EXCEPT AS THESE TERMS EXPRESSLY STATE, NEITHER INOUTBOARD.COM, INC. NOR ITS AGENTS OR SERVICE PROVIDERS (TOGETHER, THE “INOUTBOARD PARTIES”) GIVE ANY SPECIFIC PROMISE ABOUT THE SITES. WE MAKE NO COMMITMENT, FOR EXAMPLE, ABOUT THE CONTENT ON THE SITES, WHAT THE SITES SPECIFICALLY DO, THEIR AVAILABILITY OR RELIABILITY, OR WHETHER THEY WILL MEET YOUR NEEDS. THE SITES ARE PROVIDED “AS IS.”
SOME JURISDICTIONS PROVIDE CERTAIN WARRANTIES, SUCH AS THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE EXCLUDE ALL WARRANTIES TO THE EXTENT THE LAW ALLOWS.
H. Our Liability
EXCEPT WHERE THE LAW DOES NOT ALLOW IT, THE INOUTBOARD PARTIES ARE NOT LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES THAT RESULT FROM ANYONE’S USE OF THE SITES, WHETHER YOURS OR A THIRD PARTY’S. THOSE DAMAGES INCLUDE, WITHOUT LIMITATION, LOST PROFITS, LOST DATA, COMPUTER FAILURE, AND ANY THIRD PARTY’S VIOLATION OF YOUR RIGHTS. THIS APPLIES EVEN IF THE INOUTBOARD PARTIES HAVE BEEN TOLD THAT SUCH DAMAGES ARE POSSIBLE, AND WHATEVER THE LEGAL OR EQUITABLE THEORY OF THE CLAIM.
I. Free Trials, Fees and Cancellation
Free trial. You can create an account and use InOutBoard free for 30 days. We do not ask for payment details to start a trial, and the trial includes every feature.
After the trial. To keep using InOutBoard after the 30 days, add a payment method in the application under Settings → Payment Center. If no payment method has been added when the trial ends, you lose access to the service and can no longer sign in.
Your organization’s information is not deleted at that moment—email us at support@inoutboard.com and we can help you pick up where you left off—but from then on it stands on the same footing as a canceled account, and we keep it only for as long as we need to. You can ask us to delete it at any time.
Custom solutions. Organizations considering a custom-built, privately hosted solution use this same 30-day trial to evaluate the service. The custom work itself is separate: it begins only once a statement of work has been signed and paid in advance, and that agreement—not this section—sets its terms.
Fees. What you pay depends on the license size you choose, which is the number of people you can have on the status board. Current prices for every license size are on our pricing page. Monthly, quarterly and annual billing are available: quarterly is billed at three months’ price, annual at eleven months’ price.
Changing license size. You can change your license size at any time. The new size applies as soon as you save it, so the number of people you can have on the status board changes right away. The price changes from your next billing date; nothing is charged or refunded in the middle of a term.
Canceling. To cancel, email us at support@inoutboard.com and tell us the date you would like your access to end. We will end it on that date.
After cancellation. We keep your organization’s information only for as long as we need it, and then delete it. You can ask us to delete it sooner. Our Privacy Statement describes how we set retention periods.
J. Other Terms
We may change these Terms at any time, so please check them regularly. If you keep using or signing in to the Sites after a change, you accept the revised Terms. If you do not accept them, stop using and signing in to the Sites.
The Sites may link to websites run by other companies. A link does not mean we control or endorse that website, or any goods or services sold on it.
If you break these Terms and we do not act straight away, that does not mean we accept what you did, and we have not given up any of our rights, including the right to act later.
These Terms are governed by and interpreted under the laws of the State of Texas, without regard to its conflict-of-laws rules. You agree that the courts located in Houston, Texas, have exclusive jurisdiction over any claim or dispute arising under these Terms or from your use of the Sites, and you submit to the personal jurisdiction of those courts to litigate any such claim or dispute. If any provision of these Terms is found to be unenforceable, the remaining provisions are not affected.
You can ask us to disclose, correct, or delete the personal information we hold about you; our Privacy Statement explains how. For questions about how we handle personal information, email support@inoutboard.com or use our contact form.
